Acceptance of terms

By accessing and using the Klarway platform, you agree to be bound by these Terms and Conditions. If you do not agree with any of the terms set out here, we ask that you do not use our services.

Service description

Klarway is an AI-powered online proctoring platform that enables educational institutions to monitor the integrity of remote assessments. Services include camera and microphone monitoring, biometric verification, detection of irregular behaviour and report generation.

Permitted use

Users agree to use the platform solely for the purposes established by their educational institution.

The following is expressly prohibited:

• Attempting to circumvent or manipulate the monitoring systems.
• Sharing access credentials with third parties.
• Reverse engineering the software or its components.
• Using the service for illegal or unethical activities.

Intellectual property

All intellectual property rights in the platform, including software, algorithms, interfaces and documentation, are the exclusive property of Klarway or its licensors. Use of the platform does not grant any rights over such intellectual property.

Privacy and data processing

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. Klarway acts as data processor on behalf of the educational institution, which acts as the data controller.

Limitation of liability

Klarway shall not be liable for indirect, incidental, special or consequential damages arising from the use or inability to use the platform. Klarway's maximum liability to any client institution shall be limited to the amount paid for services during the three (3) months prior to the event giving rise to the claim.

Service availability

Klarway undertakes to maintain the platform available with a monthly SLA of 99.5%, excluding scheduled maintenance notified at least 48 hours in advance.

Modifications

Klarway reserves the right to modify these Terms and Conditions at any time. Modifications will take effect upon publication on this page. Continued use of the platform following the publication of changes implies acceptance of the new terms.

Applicable law and jurisdiction

These Terms and Conditions are governed by the laws of the Argentine Republic. For any dispute, the parties submit to the jurisdiction of the ordinary courts of the Autonomous City of Buenos Aires, expressly waiving any other jurisdiction.
